12.08.090 Use of funds and city participation in street improvement.
The board of public works and safety is authorized to use funds
available for street improvement
purposes to participate with the owners of lands abutting streets within the city in the improvement
of such streets in accordance with the requirements of the board of public works and safety and the
standards for street improvements established in the city ordinance providing for the control of the
subdivision of land and this chapter. For any such participation project, the board shall be
governed by the following policies:
A. The city shall not participate in
the cost of constructing any street which is less than thirty
feet, back of curb to back of curb. When the width of the street is required to be greater than thirty
feet, back of curb to back of curb, by this chapter, the city shall bear the entire cost of such greater
width which shall be deemed to be taken from the center of the street. Where the width of the street
is desired to be greater than thirty feet, back of curb to back of curb, by the owner, and such
greater width has been approved by the city plan commission and the board of public works and
safety, such owner shall bear the entire cost.
B. The cost of grading, excavating and
acquiring any right-of-way that may be needed in
connection with the improvement of streets hereafter dedicated shall not be considered a part of the
improvement cost in which the city can participate. (Prior code § 27-24)
