In the event the contractor fails to comply with the stakes,
instructions or the specifications of
Sections 13.04.020 through 13.04.050, he shall be given an opportunity to correct such violation to
the satisfaction of the board of public works and safety. The persistent failure or refusal of any
contractor to comply with these specifications, or to do work equal to that called for herein, shall
be reported by the city engineer to the board of public works and safety, and the city engineer may
then be directed by the board of public works and safety to refuse to set stakes for such reported
contractor. Any contractor doing any new concrete work on the streets, alleys or sidewalks of the
city without the necessary grade and line stakes, as set by the city engineer, shall be considered to
be trespassing on such streets or alleys and shall be prosecuted for the same. (Prior code § 27-42)
