Section 16.32.020 Criteria.
16.32.020 Criteria.
A. In the exercise of this section, the
commission shall grant such modification or exception
only upon the determination that:
1. The grant will not be detrimental
to the public, health, safety and general welfare;
2. Adjacent property will not be adversely
affected;
3. The grant is justified because of
exceptional topographic or other physical conditions
unique to the property involved as opposed to mere inconvenience or financial disadvantage;
4. The grant is consistent with the intent
of this and other applicable ordinances and the
comprehensive plan;
5. The grant will not conflict with the
requirements of the zoning ordinance, including but not
limited to lot area, lot frontage, lot width and setback(s).
B. A request for a modification shall
be submitted in writing and state the grounds for the
request. If approved by the commission, the minutes of the commission shall reflect the decision
and reason. The commission may attach such conditions as will reasonably secure the objectives
and requirements of this chapter. (Prior code § 28-68)
