5.04.040 ApplicationContents.
A. Applicants for a license under this
chapter, whether a person, firm or corporation, shall file
a written sworn application signed by the applicant, if an individual, by all partners if a
partnership, and by the president of a corporation, and attested to by the secretary of said
corporation, if a corporation, with the clerk-treasurer.
B. Transient Merchants or Itinerant Vendors.
Persons applying for a transient merchant's or
itinerant vendor's license, must show the following information:
1. Name or names of the person or persons
having the management or supervision of the
applicant's business during the time that it is proposed that it will be carried on in the city; the
local
address or addresses of such person or persons while engaged in such business; the permanent
address or addresses of such person or persons; the capacity in which the person or persons will act
(i.e., whether as proprietor, agent or otherwise); the name and address of the person, firm or
corporation for whose account the business will be carried on, if any; and, if a corporation under
the laws of what state the same is incorporated;
2. The place of places in the city where
it is proposed to carry on applicant's business, or
whether such business will be carried on house-to-house, and the length of time during which it is
proposed that said business shall be conducted; whether the goods or products are to be sold from
stock in possession, from stock and by sample, at auction, by direct sale, or by direct sale and by
taking orders for future delivery; where the goods or products proposed to be sold are
manufactured or produced; where such goods or products are located at the time said application is
filed; the warranties, if any, which will be given with such goods and products;
3. The place or places, other than the
permanent place of business of the applicant, where the
applicant within the six months preceding the date of application, conducted a transient business,
stating the nature thereof and giving the address of any building or office in which such business
was conducted;
4. If the applicant proposes to offer
goods, wares or merchandise, a statement of their nature,
character and quality;
5. If the applicant proposes to provide
a service, a statement of its nature, character and
quality; whether the applicant, the person soliciting or others will provide the service, whether the
service will be performed at the time of the purchase or at a future date; whether any goods or
products will be sold as a part of such service; the warranties, if any, which will be given with such
service;
6. A brief statement of the nature and
character of the advertising done or proposed to be done
in order to attract customers, and copies of all the advertising, whether by hand bill, circular,
newspaper advertising or otherwise, shall be attached to the application;
7. Whether the person or persons having
the management or supervision of the applicant's
business have been convicted of a crime, misdemeanor or the violation of any municipal ordinance,
the nature of the offense and the punishment assessed therefor;
8. Credentials from the person, firm
or corporation for which the applicant proposes to do
business, authorizing the applicant to act as such representative; and
9. Such other reasonable information
as to the identity or character of the person or persons
having the management or supervision of the applicant's business or method or plan of doing
business as the clerk-treasurer may deem proper to fulfill the purposes of this chapter in the
protection of the public good.
C. Food Vendors. Persons applying for
a food vendor's license shall show the following
information:
1. The name of the person or persons
having the management or supervision of the applicant's
business during the time that it is proposed that it will be carried on in the city; the local address
or
addresses of such person or persons while engaged in such business; the permanent address or
addresses of such person or persons; the capacity in which such person or persons will act (i.e.,
whether as proprietor, agent or otherwise); the name and address of the person, firm or corporation
for whose account the business will be carried on, if any; and if a corporation, under the laws of
what state the same is incorporated;
2. The place or places in the city where
it is proposed to carry on applicant's business, and
whether such business will be carried on by use of any wagon, motor vehicle or pushcart;
3. The name of the owner of each wagon,
motor vehicle or pushcart; the name or names of the
persons that will operate such wagon, motor vehicle or pushcart; and the license plate number if
said wagon, motor vehicle or pushcart has such a number;
4. Any product, merchandise, food or
beverage intended for human consumption to be sold by
the applicant;
5. A brief statement of the nature and
character of the advertising done or proposed to be done
in order to attract customers, and copies of all the advertising, whether by hand bill, circular,
newspaper advertising or otherwise, shall be attached to the application;
6. The place or places, other than the
permanent place of business of the applicant within six
months preceding the date of the application, conducted a food vendor's business, stating the nature
thereof and giving the address of any building or office in which such business was conducted;
7. Whether the person or person having
the management or supervision of the applicant's
business have been convicted of a crime, misdemeanor or the violation of any municipal ordinance,
the nature of the offense and the punishment assessed therefor;
8. Credentials from the person, firm
or corporation for which the applicant proposes to do
business, if any, authorizing the applicant to act as such representative; and
9. Such other reasonable information
as to the identity or character of the person or persons in
the management or supervision of the applicant's business or method or plan of doing business as
the clerk-treasurer may deem proper to fulfill the purposes of this chapter in the protection of the
public good.
D. Public Gatherings. Persons applying
for a license for a public gathering shall show the
following:
1. The name or names of the person or
persons having the management or supervision over the
public gathering during the time that it is proposed to be carried on in the city; the local address
or
addresses of such person or persons while engaged in such event; a permanent address or addresses
of such person or persons; the capacity in which such person or persons will act (i.e., whether as
proprietor, agent or otherwise); the name and address of the person, firm or corporation on whose
account the public gathering will be carried, if any; and if a corporation, under the laws of what
state the same is incorporated;
2. A full description of the nature of
the public gathering and any attractions thereunder;
3. The place or places in the city where
it is proposed to carry on applicant's public gathering,
and the length of time during which it is proposed that the gathering shall be conducted;
4. The place or places other than the
permanent place of business of the applicant, where the
applicant within the six months preceding the date of the application, conducted a public gathering
stating the nature thereof and giving an address of any building or office in which such public
gathering was conducted;
5. If the applicant proposes to offer
goods, wares or merchandise for sale, a statement of their
nature, character and quality;
6. If the applicant proposes to provide
an entertainment or service, a statement of its nature,
character and quality; whether the applicant or others will provide the service or the entertainment;
the warranties, if any, which will be given with such service; the names of the persons to be in
charge of each attraction or exhibition or subordinate attraction or exhibition within the public
gathering; whether there will be subletting of space for concessions to person responsible to the
general management, and if so, a statement that the sublettor will be responsible to the applicant;
7. A brief statement of the nature and
character of the advertising done or proposed to be done
in order to attract customers and copies of all said advertising, whether by hand bill, circular,
newspaper advertising or otherwise, shall be attached to the application;
8. A statement that the public gathering
and any attractions or exhibitions thereunder, will
comply with the laws of the state of Indiana and the ordinances of the city, including the health and
criminal codes thereof; that the applicant intends to operate a clean operation; and that applicant
does not intend to allow any civil or criminal violations occur on or about the grounds to be used
for the public gatherings;
9. Whether the person or persons having
the management or supervision of the applicant's
gathering have been convicted of a crime, misdemeanor or the violation of any municipal
ordinance, the nature of the offense and the punishment assessed therefor;
10. Credentials from the person, firm
or corporation for which the applicant proposes to
arrange this gathering, authorizing the applicant to act as such representative; and
11. Such other reasonable information
as to the identity or character of the person or persons
having the management or supervision of the applicant's gathering or method or plan of organizing
the public gathering as the clerk-treasurer may deem proper to fulfill the purposes of this chapter
in
the protection of the public good.
E. Clairvoyants or Fortune Tellers. Persons
applying for a clairvoyant's or fortune teller's
license shall show the following:
1. The name or names of the person or
persons having the management or supervision of the
applicant's business during the time that it is proposed that it will be carried on in the city; the
local
address or addresses of such person or persons while engaged in such business; the permanent
address or addresses of such person or person; the capacity in which such person or persons will
act (i.e., whether proprietor, agent or otherwise); the name or
address of the person, firm, or corporation on whose account the business will be carried out, if
any; and if a corporation, under the laws of what state the same is incorporated;
2. The place or places in the city where
it is proposed to carry on applicant's business, and the
length of time which it is proposed that said business shall be conducted;
3. The place or places, other than the
permanent place of business of the applicant, where the
applicant within the six months preceding the date of that application, conducted the business,
stating the address of any building or office in which such business was conducted;
4. A brief statement of the nature and
character of the advertising done or proposed to be done
in order to attract customers, and copies of all advertising, whether by hand bill, circular,
newspaper advertising or otherwise, shall be attracted to the application;
5. Whether the person or persons having
the management or supervision of the applicant's
business have been convicted of a crime, misdemeanor or the violation of any municipal ordinance,
the nature of the offense and the punishment assessed therefor;
6. Credentials from the person, firm
or corporation for which the applicant purposes to do
business, if any, authorizing the applicant to act as such representative; and
7. Such other reasonable information
as to the identity or character of the person or persons
having the management or supervision of the applicant's business as the clerk-treasurer may deem
proper to fulfill the purposes of this chapter in the protection of the public good.
F. Billiard Halls, Pool Rooms, Amusement
Game Machine Parlor. Persons applying for a
license for a billiard hall, pool room or amusement game machine parlor, shall show the following:
1. The name or names of the person or
persons having the management or supervision of the
applicant's business; the capacity in which such person or persons are authorized to act (i.e.,
whether a proprietor, agent or otherwise); the name and address of the person, firm or corporation
for whose account the business will be carried out, if any; and if a corporation, under the laws of
what state the same is incorporated;
2. The place or places in the city where
it is proposed to carry out applicant's business and the
length of time which it is proposed said business shall be conducted;
3. The number of tables or games used
in the business;
4. A brief statement of the nature and
character of the advertising done or proposed to be done
in order to attract customers, and copies of all the advertising, whether by hand bill, circular,
newspaper advertising or otherwise, shall be attached to the application;
5. Whether the person or persons having
the management or supervision of the applicant's
business have been convicted of a crime, misdemeanor or the violation of any municipal ordinance,
the nature of the offense and the punishment assessed therefor;
6. Credentials from the person, firm
or corporation for which the applicant proposes to do
business, authorizing the applicant to act as such representative; and
7. Such other reasonable information
as to the identity or character of the person or persons
having the management or supervision of the applicant's business as the clerk-treasurer may deem
proper to fulfill the purposes of this chapter in the protection of the public good. (Prior code §
