A.    The commission may defer proceedings under this chapter and transfer a complaint to the Indiana Civil Rights Commission if the Indiana Civil Rights Commission has been recognized by the United States Department of Housing and

Urban Development as having adopted statutes providing fair housing rights and remedies that are substantially equivalent to the rights and remedies granted under federal law.

    B.    The commission may defer proceedings under this chapter and transfer a complaint to the Department of Housing and Urban Development pursuant to the rules and regulations of this commission and of the Department of Housing and Urban Development.
